I have a 95 dauntless 13 with 40 hp yamaha . The trim works fine when sitting still in or out of water but does not work when I am moving. I just got the boat and haven't had a chance to take it to a mechanic . I wanted to use it a few times before winter but6am now scared i will tear something up. any advice

Sounds like from what you are describing that it works only in Neutral and not when it is in gear. If this is the case then I would guess that you have a short in the trim switch at the control box. Not sure if you motor has a built in trim switch on the motor itself, but if it does that while ruinning slowly and very carefully, see if you can get someone to press that button to up and down while you are running. Be carfeful as this could be dangerous at a fast speed

Check the fluid level. Could be that the fluid is low and when not moving there is no load on the unit. Also, there is a screw that you might want to check as well. It should be on the starboard side and is used to release fluid pressure in the event you can't raise or lower the TnT unit.

Also possible it only has power tilt not full blown trim and tilt. Read a manual the other day explaining PT doesn't have enough pressure to raise an engine under way. Good luck.
